In keeping up with the guardianship case concerning Michael Jackson's children, many are wondering if the 79 year old grandmother, Katherine Jackson will prevail in gaining the guardianship rights of the children in court. If Debbie Rowe seeks guardianship the chances of Katherine gaining legal guardianship is lowered.
It is not automatic that the biological parent has the right to custody in California. On the other hand however, in a recent article from the Christian Science Monitor, it suggests that "Just because Michael Jackson's will states Katherine is to become the legal guardian doesn't automatically mean Katherine Jackson gets to be their guardian." So we ask who will prevail in this up and coming court battle? Do we need to focus on California's current court ruling that says "Only parents' rights to custody and rearing of their children are constitutionally protected". One more hurdle in this case however, is the fact that the biological parent, Debbie Rowe previously relinquished her parental rights.
Fortunately, the courts are beginning to give the grandparents who care for the grandchildren the opportunity to fight. But states increasingly are recognizing a child's primary caregiver as a legitimate challenger to parental rights.
The courts are always looking out for what's in the best interest of the children. Essentially, it is more protection for children, and less for parents. So, if the biological parent relinquished her right but has visitation rights (since 2006) the records indicate, yet Superstar Jackson's will left his mother, Katherine to be the legal guardian of three minor children at 79 years of age, who will prevail? The next court hearing is scheduled for July 20.
Maybe they will reach an agreement for the sake of the children.

Another celebrity matter we cannot overlook is Tiger Woods' current matrimonial situation. Amazing how the media alerted everyone to Tigers' activities. Some believe his personal life should be kept private, but others believe Tiger placed himself in the eyes of the public. He is a professional athlete so should it be expected that the public will want to know everything happening in his life? What issues will the courts need to decide when all the "other women" involved with him in the past come forward? It shall be an interesting and entertaining controversy for some time. And what about the pre-nupt. Is it going to stand up in court if his actions lead to a divorce? We will most likely soon find out.
